Evolv provides done-for-you artificial intelligence and marketing automation services for home-service and small businesses, which may include lead capture and follow-up, content creation and scheduling, social media publishing, review and reputation workflows, and related integrations. The specific scope of services is defined in your service agreement, proposal, or subscription plan. We may modify, add, or discontinue features at our discretion.
You must be at least 18 years old and authorized to act on behalf of the business you represent. You agree to provide accurate, current information and to keep it updated. You are responsible for maintaining the confidentiality of any credentials and for all activity under your account.
Our services integrate with third-party platforms (including Meta/Facebook, Instagram, Google, YouTube, and CRM tools). By connecting an account, you represent that you own or are authorized to manage it, and you grant Evolv permission to access and act on it solely to deliver the services you request. Your use of those platforms remains subject to their respective terms and policies. Evolv is not responsible for changes, outages, restrictions, or actions taken by third-party platforms.
You retain ownership of the content, branding, and materials you provide. You grant Evolv a limited license to use, adapt, schedule, and publish that content as necessary to deliver the services. Evolv retains all rights to its own methods, software, templates, and systems. Deliverables created specifically for you are licensed to you for your business use upon payment; our underlying tools and processes remain our property.
Fees, billing cycles, and payment terms are set out in your service agreement or subscription plan. Unless otherwise stated, fees are due in advance and are non-refundable except as required by law or expressly agreed. Late or failed payments may result in suspension of services.
You agree not to use our website or services to: violate any law or third-party rights; send spam, deceptive, or unsolicited communications; upload malicious code; attempt to gain unauthorized access to our systems; or misuse connected platform access. We may suspend or terminate services for violations.
Services are provided "as is" and "as available." While we work to deliver effective automation and marketing outcomes, we do not guarantee specific results, revenue, leads, rankings, or engagement. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Evolv and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of our website or services. Our total aggregate liability for any claim will not exceed the amount you paid us for the services in the three (3) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Evolv from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your content, your use of the services, your violation of these Terms, or your violation of any law or third-party rights.
Either party may terminate services as provided in your service agreement. Upon termination, your right to use the services ends, and we will cease acting on your connected accounts. You may revoke platform access at any time through the relevant platform's settings. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
